Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Valdiviana (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

2. Service Description

Valdiviana provides AI-generated documents across categories including career, legal, finance, personal, and business. The Service operates on a credit-based model: users purchase credits and spend them on tool outputs.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You represent and warrant that your use complies with all applicable laws.

4. Accounts and Access

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. We may suspend or terminate access for violations, misuse, or risk to the Service.

5. AI Disclosure and Risks

5.1 AI Output Accuracy

AI outputs can be inaccurate, incomplete, biased, or outdated. The Service may produce hallucinated facts or incorrect conclusions. Output quality may vary based on input quality and context.

5.2 No Professional Advice

The Service does not provide legal, financial, medical, tax, or professional advice. Use of the Service does not create any attorney-client, advisor-client, or healthcare provider relationship.

5.3 Reliance and Verification

Outputs are starting points and must be reviewed, verified, and adapted by you. We recommend professional review for legal, financial, tax, and medical matters.

You are solely responsible for the quality, accuracy, and suitability of outputs, including how your inputs affect the results.

6. Credits, Billing, and Refunds

Credits are required to generate outputs. Credits are purchased in packs, are not subscriptions, and do not expire. Prices and credit costs may change.

All purchases are final. We do not offer refunds or credits for any reason, including dissatisfaction with outputs or outcomes based on your inputs.

7. Data Retention and Deletion

Inputs and generated outputs are automatically deleted after 24 hours. Account data is retained while your account is active and as required for billing or compliance.

8. Intellectual Property

You own your inputs and the outputs generated for your account. We retain ownership of the Service, templates, software, and branding. You grant us a limited license to process your inputs to provide the Service and to use anonymized data to improve the Service.

9. Acceptable Use

You agree not to use the Service for unlawful, harmful, deceptive, abusive, or infringing purposes, or to attempt to bypass security or access data you do not own.

10. Limitation of Liability

To the maximum extent permitted by law, Valdiviana and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any losses arising from reliance on outputs.

Our total liability for any claim is limited to the amount you paid to Valdiviana in the 12 months prior to the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Valdiviana and its operator from claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason. If terminated for violation, unused credits are forfeited.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law; Arbitration; Class Action Waiver

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms will be resolved through binding arbitration on an individual basis. You waive any right to participate in class actions or class arbitration.
